OVERVIEW
Welcome to wXgp! The terms "we", "us" and "our" refer to wXgp Watercraft Racing Festivals. wXgp operates this website, including all related information, content, features, tools, and services—including event registration and series participation—to provide you with an elite racing experience (the "Services").
wXgp is powered by Webflow, which provides the platform and hosting that enables us to provide these Services to you.
By visiting our site, registering for a race series, or interacting with our content, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. To use the Services—specifically for Event or Series Registration—you may be asked to provide pilot credentials, vessel registration, and payment information. You represent that all information provided is current and complete. You are solely responsible for maintaining the security of your account credentials and for all activity occurring under your account.
SECTION 2 - EVENT & SERIES REGISTRATION
In addition to standard commerce, wXgp provides registration services for individual racing events and full-season series.
- Eligibility: Registration for a "Series" or "Event" is subject to pilot qualification, safety inspections, and adherence to wXgp-specific class rules.
- Finality: All registration fees are final. Once a pilot is registered for a Series or individual Heat, fees are non-refundable unless the event is canceled by wXgp without a makeup date.
- Transferability: Registrations are tied to the specific Pilot and Vessel entered. You may not sell, trade, or transfer your race slot to another pilot without express written consent from wXgp Race Officials.
- Technical Compliance: By registering, you agree that your watercraft meets all safety and technical specifications outlined in the wXgp Rulebook.
SECTION 3 - PRICES AND BILLING.
- You agree to provide current, complete, and accurate purchase and account information for all transactions.
- You represent that you are authorized to use the payment method provided.
- wXgp is not responsible for any bank fees or currency conversion charges incurred during the registration process.
SECTION 4 - INTELLECTUAL PROPERTY
Our Services, including logos, race photography, branding, and the "wXgp" name, are owned by wXgp, its affiliates, or licensors.
- You may not use our trademarks or copyrighted media for commercial purposes without prior written consent.
- Media Release: By registering for an event or series, you grant wXgp a perpetual, worldwide license to use your likeness, name, and vessel imagery in promotional materials, broadcasts, and social media.
SECTION 5 - RELATIONSHIP WITH WEBFLOW
wXgp is hosted and powered by Webflow. By using the Services, you acknowledge that Webflow is a third-party service provider and is not responsible for the direct management of race events, pilot safety, or the fulfillment of participation rewards. You hereby release Webflow and its affiliates from all claims and liabilities arising from your transactions and participation with wXgp.
SECTION 6 - PROHIBITED USES
You may not use our site or registration portal:
- For any unlawful purpose or to solicit others to perform unlawful acts.
- To submit false or misleading pilot/vessel information.
- To interfere with the timing and scoring data of our events.
- To harass, abuse, or intimidate wXgp employees, officials, or other participants.
- To circumvent the security or authorization features of the Webflow platform.
SECTION 7 - LIMITATION OF LIABILITY
Racing is an inherently dangerous sport. To the fullest extent provided by law, in no case shall wXgp, our race directors, marshals, or safety crews—nor Webflow—be liable for any injury, loss, or claim arising from your participation in a wXgp event or your use of our digital services. All participants are required to sign a separate Liability Waiver prior to entering the water.
SECTION 8 - GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. You and wXgp consent to the exclusive jurisdiction of the courts located in Tarrant County, Texas.
